This document outlines the Terms and Conditions for Canada Top Clean. By using our website or booking our services, you are entering into a legally binding agreement. Please read these carefully, as they include important information regarding your rights, obligations, and the limitations of our liability.
The Nature of Our Service
Canada Top Clean provides a communication platform that connects independent cleaning service providers with customers.
Platform Only: We are a venue/intermediary. We do not personally provide cleaning services. The cleaning is performed by third-party contractors.
No Liability for Providers: While we conduct background checks on our partners, we do not guarantee the quality, reliability, or safety of their work. You use these third-party services at your own risk.
Independent Contractors: No joint venture or employment relationship exists between Canada Top Clean and the cleaning professionals or between you and Canada Top Clean.
Booking and Pricing
By booking through our platform, you agree to the following financial terms:
Prevailing Pricing: Prices listed on our site are estimates. We reserve the right to determine final pricing based on the actual condition of the home.
Extreme Conditions: We reserve the right to refuse service or adjust pricing if cleaners encounter extreme conditions, including but not limited to mold, bodily fluids, smoke damage, or water damage.
Payment: All fees are due immediately upon the completion of the cleaning service.
Cancellations and Rescheduling
We value our cleaners’ time. Because they reserve specific slots for you, we enforce the following:
24-Hour Notice: Cancellations or rescheduling requests must be made at least 24 hours before the appointment.
Cancellation Fee: If you cancel or reschedule with less than 24 hours’ notice, a $45 fee will be charged to the payment method on file.
Quality Assurance and Damage Claims
Your satisfaction is our priority, but we require timely communication to resolve issues.
48-Hour Reporting Window: If you have concerns regarding the quality of service (missed areas) or identify potential damages, you must notify us at [email protected] within 48 hours.
Limitations: Reports made after the 48-hour window fall outside our scope of responsibility for investigation, resolution, or potential refunds.
Non-Solicitation (Referral Fee)
We invest significant resources in vetting and managing our cleaning partners.
Direct Hiring Prohibited: You agree not to independently hire any cleaner introduced to you through Canada Top Clean.
The “Poaching” Fee: If you choose to hire a Canada Top Clean cleaner privately, you agree to pay a one-time referral fee of $3,000, due immediately upon the personal employment of the cleaner.
User Representations
By using our site, you represent and warrant that:
1. You are at least 18 years old and capable of entering into a binding contract.
2. You will use the service only for lawful, personal, and non-commercial purposes.
3. You will not attempt to harm the software, reverse engineer our platform, or bypass our security measures.
Limitation of Liability
To the maximum extent permitted by law:
“As-Is” Basis: Our service is provided without any warranties of any kind. We do not guarantee that the service will meet your expectations or be error-free.
Liability Cap: Our total aggregate liability will never exceed the total amount you paid to Canada Top Clean in the six months prior to the claim.
Indirect Damages: We are not liable for indirect, punitive, or consequential damages (such as loss of profits or personal injury) resulting from the use of our platform or the third-party cleaning services.
Governing Law and Dispute Resolution
Jurisdiction: These terms are governed by the laws of the Province of Ontario.
Binding Arbitration: Any disputes or claims arising from this agreement will be settled exclusively through binding arbitration in Toronto, Ontario, rather than in court.
Class Action Waiver: You agree to resolve any claims on an individual basis and waive your right to participate in a class-action lawsuit.
Privacy Policy Summary
We respect your privacy. We collect personal information (like name, address, and payment info) solely to fulfill your service requests.
We use industry-standard security safeguards to protect your data.
We only retain your information for as long as necessary to provide our services or comply with legal obligations.
We do not sell your personal data to third parties.
